INTRODCUTION
These Terms and Conditions ("Terms") govern your access to and use of the services, products and Mifren websites (the "Services"), and any content (text, graphics, photos or other materials uploaded, downloaded or appearing on the Services). Your access to and use of the Services and products is conditioned on your acceptance of and compliance with these Terms and conditions. By accessing or using the Services or purchasing the products, you agree to be bound by these Terms. These Terms and conditions consists of two sections, one section outlines the terms for our Travel products and services (Airline, Cruise, Hotel, Restaurant, Car Rental etc.), and the other section explains the terms for all the other services we offer. You are responsible for your use of the Services, for any Content you post to the Services, and for any consequences thereof. The Content you submit, post, or display will be able to be viewed by other users of the Services and through third party services and websites. You should only provide Content that you are comfortable sharing with others under these Terms. Content that is submitted during purchase of travel products and services is excluded from the above basic terms. For the full terms and conditions of our travel services, refer to the “Terms for Travel Services and Products” of this agreement. You may use the Services only if you can form a binding contract with Mifren and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.
Terms for Travel Services and Products
Mifren shall not be liable for travel service providers, which include, but not limited to Airlines, Hotels, Cruise Lines, Car Rental agencies and Tour Operators; to perform the services provided by such providers. We are a Travel Management Services company connecting you to travel service providers, and do not guarantee or insure the services to be provided by any travel service provider, the financial position of such providers or the reimbursement to you from any loss experienced as a result of the financial condition of such provider. In the event that a travel service provider defaults prior to providing the service to you for, which payment has been made, the sole recourse for refund shall be with the defaulting travel service provider, which may be permitted by law or statute. Mifren strives to maintain the highest standards of service in the trade and will use appropriate care in selecting suppliers so as to protect you from such default. Except where expressly stated herein, Mifren assumes no responsibility for actions relating to travel services beyond the control of Mifren (Bavolar L.L.C) or its employees. Mifren is not responsible or liable for any act, error, omission, injury, loss, accident, damage, delay, nonperformance, irregularity, or any consequence thereof, which may be occasioned through neglect, or default or any other act or inaction of any supplier of Travel products or services. Mifren shall not be liable for any fluctuation in price or change in schedule or equipment or accommodations for any travel service, which occurs subsequent to payment for such service. As an affiliate of World Choice Travel (WCT), Mifren acts as a travel service agency that provides value added service to Travelers. Mifren has no control over and assumes no liability for the actions of the travel service providers from whom it obtains Travel products. For your convenience Mifren has included its service agency fee in the fare quoted to you. Our service agency fee may vary depending on a number of factors, including the market conditions, the amount of savings we pass on to you, the time and effort we spend on locating the tickets you request at the best prices, upgrades applied if any, your form of payment, etc.
Once tickets have been issued there may be a penalty involved for refunds. We do not have control over printed prices on the tickets, although most tickets may have BT (Bulk fare) printed on them, some may have a specific value on them, which may be different (lower or higher) than the fare collected. We are committed to 100% customer satisfaction. If you are dissatisfied for any reason, please contact Customer Care.

FARE CHANGES |
At times even after the confirmation of a reservation the fare may change, we will notify you of any fare changes and we do not assume any responsibility - financial or otherwise for any such fare changes. We will notify you of the new fare and at that point you may either cancel or still purchase the product at the new cost.
TICKET DELIVERY |
If an e-ticket could not be issued for a particular reservation or if a delivery was being made of another product or service, World Choice Travel (WCT) will send the paper ticket, product or service through a secure mode of delivery (a reputed courier company) and the applicable shipping charges debited to the credit card holder's account as per rates published on our website. World Choice Travel (WCT) does not assume any responsibility for the fault of the delivery company. We will attempt to redeliver but do not provide any guarantees for redelivery on time. If you provide incorrect address, then you may have to pay excess fees to the delivery company for alteration of the address. You will be billed to the credit card used for payment. If an e-Ticket is generated the ticket information will be available on the web-site.
- All credit cards must have verifiable US or Canadian billing address.
- If you are using Third party credit card, please contact us at 212 763 0481 with your requirements.
- If there is any issue with the Credit card, we will notify you within 24Hrs, by submitting the Credit Card; it automatically does not guarantee "Ticketing".
- Mifren bears no responsibility in the event your Credit card is not charged by Mifren. There can be number of reasons for which credit card may not have been charged by Mifren. Viz Airlines has not confirmed the booking, Fare has increased since payment information is submitted, Insufficient funds available in the credit card etc.
- You are agreeing to reimburse the commissions back to Mifren if the client/traveler disputes the credit card payments.
- Mifren uses stringent safety measures for credit card payment processing. Fraudulent transactions if any, are reported to Airport Security, Airlines and other Federal and State organizations
- You agree to be liable for any and all credit card payments disputes or other problems such as Fraud made to us or the supplier on behalf of your client. You agree to reimburse Mifren in cases of Fraud or Charge backs.
- All credit card transactions over phone to our Customer Service Department are recorded and are available as evidence in case of any dispute or for legal form of evidence.
- Credit card transactions are authorized by user’s accepting terms and conditions or electronic signature.
When there are 2 airlines involved for connecting flights then you may have to re-claim your bags at Connecting Airport and check in again for onward journey. You are also advised that in these cases if you have excess baggage, you will have to pay this twice, for each airline.
At times for HIGH RISK transactions such as one way International tickets, foreign origination tickets, we may need a Credit Card Authorization form to be filled out by the card holder. We do NOT guarantee that the fares may be valid until we receive the credit card authorization form filled out. At times the tickets may be issued even if we have not received the form back. All issued tickets are NON REFUNDABLE.
GENERAL RESTRICTIONS |
All flights should be confirmed with the airline directly as they may have last minute schedule changes. We recommend that you do so at least 24 hours prior to departure for domestic flights (72 hours for flights to Hawaii and international destinations).
In most cases, upgrades standbys will not be permitted.
Many of our discounted tickets do not allow for Frequent Flyer Mileage Accrual.
Seat assignments will be made at the airport on the day of departure or by contacting the airline directly.
Tickets will not be sold to unaccompanied minors age 18 and under. Tickets may be purchased for minors age 18 and under; however, they must be accompanied by an adult when traveling.
We reserve the right to cancel requests for High Security Risk Areas.
All customers are advised to know the entry requirements for the country(ies) to which they are traveling or entering. Reliable information regarding international travel can be found at www.travel.state.gov.
Mifren’s sale of tickets to you does not imply any guarantee of passenger's ability to enter the country of destination. Traveler understands that Mifren (Bavolar L.L.C) accepts no responsibility for determining passenger‘s eligibility to enter any specific country.
A passenger’s duty or departure tax may be assessed upon departure from some international destinations such as Mexico, and the United Kingdom and Australia. This is the passengers responsibly and is not collected by Mifren upon purchase.
A $26.00 administrative fee will be charged for travel receipts requested after departure.
We encourage you to re-confirm your flight schedules with the airlines 72 hours prior to departure. These days many airlines make changes due to reasons only known to them.
Please note we shall make our best efforts to notify you of any such schedule changes. However it is not a guarantee that we shall be always able to make successful contact with you through phone or email to deliver to you such important travel update. We do not own any liability for cancelled flights, flights that are missed or flights mis-connection due to any scheduled changes.
Mifren is not responsible for any tickets that could not be processed due to inaccurate and/or incomplete verification of credit card information, or due to other technical mal-function with our systems. If we are unable to contact you, we reserve the right to cancel your booking. We will send an e-mail advising you of the cancellation and this will serve as the final notification. Please note, Mifren (Bavolar L.L.C, World Choice Travel (WCT)) will not be responsible for any fare increase if you decide to rebook the itinerary.
It is the responsibility of the passenger who has booked with us online or has made booking over phone to review and reconfirm names, dates, flight numbers, airlines, routing including any airport changes are in accordance and acceptance of the passenger. If you discover any discrepancy or you don’t agree, you are requested to immediately contact Mifren over the phone not over 4 hours from the time booking is made.
If we don’t hear from you within 4 hours we shall consider the booking you have made is acceptable to you and we don’t hold any liability thereafter for any changes whatsoever.
By approving this transaction you are authorizing Mifren to send you communication in the form of email, postal mail, instant messaging, phone call, text messaging and any other form of electronic or paper communication. This communication will be primarily for customer service and may include special offers from time to time.
We are constantly making improvements and updates to Mifren and as such, the form and nature of the Services that Mifren provides may change from time to time without prior notice to you. Additionally, we may make changes resulting in certain services (or any features within the Services) to be discontinued (permanently or temporarily) and may not be able to provide you with prior notice. We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you.
The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by Mifren on the Services are subject to change. In consideration for Mifren granting you access to and use of the Services, you agree that Mifren and its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others.
Any information that you provide to Mifren is subject to our Privacy Policy, which governs our collection and use of your information.
You are responsible for safeguarding the Access Credentials (“password”) that you use to access the Services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. Mifren cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk.
We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will Mifren be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.
You retain your rights to any Content you submit, post or display on or through the Services. By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).
On the condition that you comply with all your obligations under this Agreement, we grant you a limited, revocable, nonexclusive, nonassignable, nonsublicenseable license and right to access the Services, through a generally available web browser, mobile device or application (but not through scraping, spidering, crawling or other technology or software used to access data without the express written consent of Mifren or its Users), view information and use the Services that we provide on Mifren WebPages and in accordance with this Agreement. Any other use of Mifren contrary to our mission and purpose (such as seeking to connect to someone you do not know or trust, or to use information gathered from Mifren commercially unless expressly authorized by Mifren) is strictly prohibited and a violation of this Agreement. We reserve all rights not expressly granted in this Agreement, including, without limitation, title, ownership, intellectual property rights, and all other rights and interest in Mifren and all related items, including any and all copies made of the Mifren website.
We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.
You are responsible for your use of the Services, for any content you provide, and for any consequences thereof, including the use of your Content by other users and our third party partners. You understand that your Content may be rebroadcasted by our partners and if you do not have the right to submit Content for such use, it may subject you to liability. Mifren will not be responsible or liable for any use of your Content by Mifren in accordance with these Terms. You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content that you submit.
For as long as Mifren continues to offer the Services, Mifren shall provide and seek to update, improve and expand the Services. As a result, we allow you to access Mifren as it may exist and be available on any given day and have no other obligations, except as expressly stated in this Agreement. We may modify, replace, refuse access to, suspend or discontinue Mifren, partially or entirely, or change and modify prices for all or part of the Services for you or for all our users in our sole discretion. All of these changes shall be effective upon their posting on our site or by direct communication to you unless otherwise noted. Mifren further reserves the right to withhold, remove and or discard any content available as part of your account, with or without notice if deemed by Mifren to be contrary to this Agreement. For avoidance of doubt, Mifren has no obligation to store, maintain or provide you a copy of any content that you or other Users provide when using the Services.
Mifren may include links to third party web sites (“Third Party Sites”) on www.Mifren.com, and elsewhere. You are responsible for evaluating whether you want to access or use a Third Party Site. You should review any applicable terms and/or privacy policy of a Third Party Site before using it or sharing any information with it, because you may give the operator permission to use your information in ways we would not.
Mifren is not responsible for and does not endorse any features, content, advertising, products or other materials on or available from Third Party Sites. Accordingly, if you decide to access Third Party Sites, you do so at your own, and that this Agreement does not apply to your use of any Third Party Site.
Please note: If you allow an Platform Application or Third Party Site to authenticate to or connect with your Mifren account, that application or website can access information on Mifren related to you and your connections.
You acknowledge, consent and agree that we may access, preserve, and disclose your registration and any other information you provide if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary in our opinion to: (1) comply with legal process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce this Agreement; (3) respond to claims of a violation of the rights of third parties, whether or not the third party is a User, individual, or government agency; (4) respond to customer service inquiries; or (5) protect the rights, property, or personal safety of Mifren, our Users or the public.
Disclosures of User information to third parties other than those required to provide customer support, administer this agreement, or comply with legal requirements are addressed in the privacy policy.
You are solely responsible for your interactions with other Users. Mifren may prohibit you from contacting other Users through use of the Services or otherwise limit your use of the Services. Mifren reserves the right, but has no obligation, to monitor disputes between you and other members and to restrict, suspend, or close your account if Mifren determines, in our sole discretion, that doing so is necessary to enforce this Agreement.
You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Services in a way that constitutes copyright infringement, please provide us with the following information to forward to the appropriate authority; an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Sites; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. We reserve the right to remove Content alleged to be infringing without prior notice and at our sole discretion. In appropriate circumstances, Mifren will also terminate a user’s account if the user is determined to be a repeat infringer.
Your access to and use of the Services or any Content is at your own risk. You understand and agree that the Services is provided to you on an "AS IS" and "AS AVAILABLE" basis. Without limiting the foregoing, MIFREN AND ITS PARTNERS DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Services or any content thereon. Mifren will not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services, or any Content. You also agree that Mifren has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Services. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from Mifren or through the Services, will create any warranty not expressly made herein.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIFREN AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT MIFREN HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY OR CERTAIN WARRANTIES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
If any provision of this Agreement is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; and if a court or arbitrator finds the modified provision invalid, illegal, void or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement will not be affected in any way and will remain in full force and effect.
These Terms and any action related thereto will be governed by the laws of the State of Florida without regard to or application of its conflict of law provisions or your state or country of residence. All claims, legal proceedings or litigation arising in connection with the Services will be brought solely in Broward County, Florida, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. If you are accepting these Terms on behalf of a United States federal government entity that is legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you but instead these Terms and any action related thereto will be will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of Florida (excluding choice of law).
These Terms, the Mifren Rules and our Privacy Policy are the entire and exclusive agreement between Mifren and you regarding the Products and Services (excluding any services for which you have a separate agreement with Mifren that is explicitly in addition or in place of these Terms), and these Terms supersede and replace any prior agreements between Mifren and you regarding the Services. Other than members of the group of companies of which Mifren is the parent, no other person or company will be third party beneficiaries to the Terms.
We may revise these Terms from time to time. If the revision, in our sole discretion, is material we will notify you via an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
